Acceptance of Terms

By accessing or using MyMerkato (the "Service", including our website at mymerkato and our iOS and Android apps), you agree to be bound by these Terms of Service and our Privacy Policy and Community Guidelines, which are incorporated by reference. If you do not agree, do not use the Service. These terms apply to all users including buyers, sellers, service providers, drivers, couriers, event organizers, shop owners, roommates and roommate seekers, daters, donors, and visitors, whether on the website or in the apps.

Eligibility

You must be at least 18 years of age to use MyMerkato. By using the Service you represent and warrant that you meet this requirement, that you have the legal capacity to enter into this agreement, and that you are not barred from using the Service under the laws of your jurisdiction. The Meet People feature is exclusively for users 18 or older; enabling it is your confirmation of this.

The Service Is a Venue Only

MyMerkato is a discovery and connection platform only. We do not own, sell, resell, supply, control, inspect, warehouse, ship, or deliver any item, service, ride, delivery, event, room, or product listed, offered, or facilitated by users - including through the Providers directory, Merchant Shops, Roommate Finder, or any ride/delivery matching feature. We are not a party to, and do not guarantee the performance, completion, safety, legality, or outcome of, any transaction, booking, hire, sale, tenancy, or interaction between users. All content, conduct, products, and services offered by users are the sole responsibility of the user responsible for them, not MyMerkato, LLC.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account, whether or not authorized by you. Notify us immediately of any unauthorized use at support@f2yapps.com. MyMerkato, LLC is not liable for any loss arising from your failure to safeguard your credentials. Accounts created with an email and password must verify that email address before gaining full access to the Service; accounts created through Google or Apple sign-in are verified by that provider.

Listings, Events, and Content

You are solely responsible for any content you post - including listings, photos, videos, descriptions, prices, and any information generated with the help of our AI writing tools - and for ensuring it is accurate, lawful, non-infringing, and yours to post. Listings, ads, events, shops, and provider profiles may be subject to admin review before becoming publicly visible; approval is not an endorsement, verification, or guarantee of accuracy by MyMerkato, LLC. We may remove, hide, or refuse any content or account, at our sole discretion, at any time, with or without notice, and without liability to you.

AI-Generated Content and Features

MyMerkato offers optional AI-assisted features, including a listing-description writer, a shopping/search assistant (which may interpret a zip code or general location you type into a search), automated translation, and automated risk/fraud screening of posts. A seller may also enable an AI scheduling assistant that chats with interested buyers on the seller's behalf, answers questions from the seller's own listing details, and - once a time and place are agreed - books the meetup automatically, including adding it to a calendar. Where both people have a saved location, the assistant may show a distance estimate between the buyer and the proposed meetup address as a convenience flag; this estimate is approximate, may be wrong or unavailable, and is not a safety guarantee, background check, or endorsement of the meeting location. These tools use third-party AI models and are provided for convenience only. AI output may be inaccurate, incomplete, outdated, or inappropriate, and does not constitute advice of any kind (legal, financial, safety, or otherwise). MyMerkato, LLC does not warrant the accuracy of AI-generated text, translations, search results, distance estimates, or risk flags, and a post's risk score or lack of one is not a representation that the post, its seller, or its content is safe, legal, or genuine. A meetup time, place, or booking arranged by the AI assistant is not a promise or guarantee by MyMerkato, LLC that either party will appear or that the meeting will be safe. You are solely responsible for reviewing and verifying any AI-assisted content or arrangement before posting, meeting, or relying on it, and MyMerkato, LLC is not liable for any decision made in reliance on AI output.

Meet People Feature

The Meet People feature connects adult community members. By enabling it you confirm you are 18+, will behave respectfully, and will not send unsolicited or inappropriate content. Mutual consent (both parties connecting) is required before messaging. Before your profile can be seen or browse others, you must submit a live selfie that a human reviewer manually compares to your profile photos to confirm the same person appears in both - this selfie match is the only verification performed, and it does NOT confirm your real-world identity, legal name, age, marital status, background, criminal history, or intentions, and is not a background check of any kind. Beyond that photo match, MyMerkato, LLC does not verify the identity, background, marital status, intentions, or criminal history of any member and is not responsible for any member's conduct, statements, or representations, online or in person. You use this feature, and meet anyone through it, entirely at your own risk.

Roommate Finder

The Roommate Finder lets users post and browse listings for rooms, shared housing, and roommates. MyMerkato, LLC is not a party to, and does not broker, guarantee, or take any fee from, any lease, sublease, room-share agreement, or roommate arrangement. We do not verify the identity, creditworthiness, criminal background, tenancy history, or intentions of any poster or respondent, and we do not inspect any property. All housing arrangements, including any lease terms, deposits, house rules, and fair-housing compliance, are solely the responsibility of the individuals involved. You are strongly encouraged to meet in person, view the space, and verify identity and terms in writing before exchanging any money or moving in. MyMerkato, LLC is not liable for any misrepresentation, discrimination, unsafe condition, financial loss, or dispute arising from a housing arrangement made through the Service.

Community Care Fund

The Care Fund lets members request and pledge voluntary support. MyMerkato is not a bank, charity, escrow agent, crowdfunding platform, or payment processor. MyMerkato, LLC does not hold, transfer, collect, guarantee, insure, or take responsibility for any funds; all money moves directly between users via third-party services (e.g., Venmo, Cash App, PayPal) outside the Service. We do not verify the accuracy of any request or the good faith of any requester or donor. We are not responsible for any pledge that is unfulfilled, misused, fraudulent, or disputed, and we make no guarantee that any request will be seen, believed, or funded.

Rides & Deliveries

MyMerkato, LLC is NOT a transportation provider, carrier, courier, rideshare, or delivery company, and does not employ, screen, background-check, train, supervise, dispatch, insure, or endorse any driver, rider, courier, or sender who posts or responds to a ride or delivery listing. We perform no background, driving-record, vehicle, or insurance checks on any user. Any fare or delivery fee shown - including estimates generated from a provider's self-reported rate and calculated distance - is a non-binding ESTIMATE only; the actual amount, method, and timing of payment are agreed and paid directly between users, off the Service. You are solely responsible for holding valid insurance, licenses, permits, and registrations and for complying with all applicable transportation, courier, and safety laws. You use rides and deliveries, and any provider-matching feature, entirely at your own risk - including accident, injury, death, loss, theft, delay, non-performance, or property damage - and MyMerkato, LLC is not liable for any of it.

Providers Directory & Independent Service Providers

The Providers directory lets community members offer rides, deliveries, and other services (such as home repair, cleaning, tutoring, or events services) and lets other users browse, contact, and hire them. Anyone listed in the Providers directory is an independent, self-listed individual - NOT an employee, agent, contractor, or representative of MyMerkato, LLC, and NOT screened, licensed, bonded, insured, or background-checked by us. A "Verified" badge reflects only that a user submitted identity documents we reviewed at a point in time; it is not a guarantee of a provider's skill, honesty, licensure, insurance, safety, or good character, and does not survive changes in a provider's conduct after verification. Years of experience and whether a provider is licensed for a given service are self-reported by the provider and are not verified, confirmed, or audited by MyMerkato, LLC in any way - MyMerkato, LLC does not check any license against a real licensing board or authority. An "Available now" status, any displayed price or rate estimate, and any "fast responder" indicator are self-reported by the provider or computed from past message-response times; none of these are a promise, guarantee, contract, or dispatch commitment by MyMerkato, LLC that any provider is actually available, will respond, will honor a quoted rate, or will complete any job to any standard. IT IS YOUR OWN RESPONSIBILITY, NOT MyMerkato, LLC'S, TO SATISFY YOURSELF BEFORE HIRING OR MEETING ANY PROVIDER THAT THEY ARE WHO THEY CLAIM TO BE, ARE LEGITIMATE, AND DO NOT POSE A RISK OF FRAUD, THEFT, HARASSMENT, VIOLENCE, OR ANY OTHER HARM. This applies equally to a provider evaluating a customer. MyMerkato, LLC does not run criminal-background, sex-offender-registry, or violent-history checks on any user and has no way to detect or predict a person's intentions or conduct in advance. Take your own precautions: verify identity and any claimed license or credential independently before paying or letting someone into your home or vehicle, communicate and agree on details through the Service before meeting, meet first in a public place where practical, tell someone you trust where you're going, trust your judgment if something feels wrong, and end the interaction immediately and contact local law enforcement if you ever feel threatened or unsafe - do this before reporting it to us. You are solely responsible for vetting, negotiating with, paying, and evaluating any provider you contact - including independently confirming any claimed license or experience before hiring for licensed work - and MyMerkato, LLC is not liable for any provider's work, conduct, pricing, cancellation, no-show, licensure claim, criminal act, or any dispute between you and a provider.

Merchant Shops & Storefronts

Merchant Shops let subscribing members set up a storefront and list products, including grocery, food, and perishable items, for sale to other members. Each Shop and its products are owned and operated solely by the merchant who created it - MyMerkato, LLC does not manufacture, source, inspect, store, handle, package, or sell any product listed in a Shop, is not a party to any sale, and does not take title to any goods. The merchant is solely responsible for the accuracy, safety, legality, quality, and lawful labeling of everything they sell, including compliance with food-safety, allergen-disclosure, product-safety, recall, and consumer-protection laws applicable to their products, and for honoring any warranty, return, or refund they offer. Where a Shop indicates it "delivers locally" or offers a delivery arrangement, that arrangement is between the buyer and the merchant (or a provider the buyer separately hires); MyMerkato, LLC does not perform, supervise, or guarantee that delivery. MyMerkato, LLC disclaims all liability for any product defect, foodborne illness, allergic reaction, injury, financial loss, or dispute arising from a purchase made through a Shop, to the fullest extent permitted by law.

Delivery & Ride Matching - No Guarantee of Service

Where the Service surfaces a list of nearby people who offer rides or delivery, ranks them by estimated distance and price, or displays an "Available now" or "fast responder" indicator, that information is generated from self-reported data, device or browser location (when you allow it), and past message-response times. It is provided for your convenience only and is NOT a guarantee of any provider's actual location, availability, response time, pricing, safety record, or willingness or ability to complete a job. Distances and price estimates are approximate and may be inaccurate. MyMerkato, LLC does not dispatch, assign, supervise, or guarantee the completion of any ride or delivery arranged this way, and is not liable if no provider responds, a provider cancels or fails to appear, or an estimated price differs from the price actually charged.

Payments & Subscriptions

Optional paid features (premium listings, business plans, ad placements, Meet People Plus) are billed through the applicable app store (Apple/Google) or, on the website, through our third-party payment processor. Subscriptions auto-renew unless cancelled before the renewal date; manage or cancel them through your store account or billing portal. Refunds are governed by the relevant store or processor policy, and, except as required by law, all fees are non-refundable. MyMerkato, LLC does not store your card details. Paid plans are for your own personal or business use and may not be resold or used as a posting service for third parties; posting limits and pricing may be adjusted at our discretion with notice where required by law.

Prohibited Activities

You may not: post false, misleading, or fraudulent content, pricing, or availability; violate any law or regulation; harass, abuse, threaten, stalk, or harm others; infringe intellectual-property, publicity, or privacy rights; sell prohibited, stolen, counterfeit, recalled, or unsafe items; misrepresent your identity, credentials, licensure, or insurance as a provider; solicit funds under false pretenses; spam or send unsolicited commercial messages; impersonate MyMerkato, LLC or any user; or attempt to reverse-engineer, scrape, data-mine, overload, disrupt, or compromise the Service or circumvent any access or rate limitation.

In-Person Meetings & Assumption of Risk

Marketplace deals, deliveries, rides, provider hires, shop pickups, roommate viewings, the Care Fund, and Meet People can lead to communicating or meeting in person with people you do not know. MyMerkato, LLC does not verify the identity, background, licensure, insurance, or intentions of any user and is not responsible for any user's conduct, online or in person. You interact, meet, transact, and travel entirely at your own risk. We recommend meeting in safe public places, bringing someone you trust, inspecting items and spaces before paying, verifying a provider's insurance and licensing yourself, and never sharing financial, government-ID, or other sensitive information. You knowingly and voluntarily assume all risk arising from your interactions with other users, including the risk of physical injury, death, or property loss.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. MyMerkato, LLC DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY LISTING, USER, PROVIDER, SHOP, PRODUCT, RIDE, DELIVERY, EVENT, ROOM, OR DONATION IS GENUINE, SAFE, LAWFUL, AVAILABLE, OR ACCURATELY DESCRIBED. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM MyMerkato, LLC OR THROUGH THE SERVICE (INCLUDING FROM ANY AI FEATURE) CREATES ANY WARRANTY NOT EXPRESSLY STATED HERE.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MyMerkato, LLC AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, ADMINISTRATORS, MODERATORS, AGENTS, LICENSORS, AND VOLUNTEERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, NOR FOR ANY LOST PROFITS, LOST DATA, LOSS OF GOODWILL, PERSONAL INJURY, DEATH, PROPERTY LOSS OR DAMAGE, THEFT, FRAUD, OR FINANCIAL LOSS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR FROM ANY TRANSACTION, LISTING, PRODUCT, RIDE, DELIVERY, PROVIDER HIRE, ROOM OR ROOMMATE ARRANGEMENT, DONATION, MEETING, OR INTERACTION FACILITATED THROUGH IT, REGARDLESS OF THE LEGAL THEORY ASSERTED (CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE SERVICE MERELY PROVIDES A VENUE TO CONNECT USERS. WHERE LIABILITY CANNOT BE EXCLUDED, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID MyMerkato, LLC IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR US $100. THESE LIMITATIONS APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

Indemnification

You agree to defend, indemnify, and hold harmless MyMerkato, LLC and its owners, officers, directors, employees, administrators, moderators, agents, licensors, and volunteers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the Service; your content, listings, products, or provider or shop profile; any transaction, ride, delivery, product sale, room or roommate arrangement, donation, or meeting you take part in; your violation of these terms, our Community Guidelines, or any law; or your violation of any third party's rights.

Release of Claims Between Users

Because MyMerkato, LLC is only a venue that connects users, any dispute, loss, injury, or harm between you and another user - including a provider, shop merchant, roommate, driver, or courier - is solely between those users. To the fullest extent permitted by law, you release MyMerkato, LLC and its owners, operators, administrators, and volunteers from any and all claims, demands, and damages of every kind, known or unknown, suspected or unsuspected, disclosed or undisclosed, arising out of or connected with such disputes or interactions.

Intellectual Property & Copyright (DMCA)

The Service, its design, and MyMerkato, LLC's trademarks and logos are owned by MyMerkato, LLC and may not be used without permission. You retain ownership of content you post, but grant MyMerkato, LLC a worldwide, royalty-free, non-exclusive license to host, display, reproduce, and distribute it as necessary to operate and promote the Service. If you believe content on the Service infringes your copyright, send a written notice to contact@f2yapps.com identifying the copyrighted work, the allegedly infringing material and its location, and your contact information; we will review and may remove the content and, where appropriate, notify the poster, who may submit a counter-notice as provided under applicable copyright law.

Force Majeure

MyMerkato, LLC is not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, natural disaster, war, terrorism, civil unrest, labor disputes, internet or utility outages, governmental action, or failures of third-party providers (including Apple, Google, Firebase, or payment processors).

Governing Law & Disputes

These terms are governed by the laws of the State of Maryland, United States, without regard to conflict-of-law principles. Any dispute, claim, or controversy arising out of or relating to these terms or the Service shall be resolved exclusively through final and binding arbitration administered by a recognized arbitration provider (such as the American Arbitration Association) under its consumer arbitration rules, conducted in the State of Maryland, United States or by videoconference, on an individual basis only. YOU AND MyMerkato, LLC EACH WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Either party may bring an individual claim in small-claims court instead, where the claim qualifies. Any claim must be brought within one (1) year after it arises or it is permanently barred. This arbitration provision does not apply where prohibited by applicable law.

Severability

If any provision of these terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms of Service, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and MyMerkato, LLC regarding the Service and supersede any prior agreements. Our failure to enforce any provision is not a waiver of that or any other provision. You may not assign these terms without our consent; we may assign them freely.

Changes to These Terms

We may update these terms at any time. Continued use of the Service after changes constitutes acceptance. Material changes will be announced in-app or on the website.
